Frente a esta realidad, nos enfocaremos en conocer: los motivos por los cuales los residentes en el Gran Mendoza no utilizan el testamento como una herramienta de repartición patrimonial; cuáles son los principales obstáculos para que un ciudadano acceda al conocimiento de los modos de testar; cuál es el rol de los colegios profesionales de abogados y notarios de la provincia en la utilización del testamento; si el sistema de legítimas vigente incide en la opción para transmitir por testamento y si el hecho de no testar tiene alguna incidencia en la circulación bienes en materia inmobiliaria. |

The Civil and Commercial Code (text law n ° 26,994) has involved a substantial change in various institutions of private Argentine law, so we are interested in deepening this investigation in one of the emblematic institutes in matters of succession: the will. Although the types of wills have been simplified, the results of the court statistics show that the probate estates processed by the courts in the Greater Mendoza are percentage low in relation to all the successions whose formalities began as of the year 2015. this reality, we will focus on knowing: the reasons why the residents of the Greater Mendoza do not use the testament as a tool of patrimonial distribution; what are the main obstacles for a citizen to access knowledge of the ways of testing; what is the role of the professional associations of lawyers and notaries of the province in the use of the will; if the current legitimate system affects the option to transmit by testament and if the fact of not testing has any impact on the circulation of real estate property.
