Las justicias comunitaria e indígena se enfrentan no sólo a la exclusión y el racismo de la justicia de estado, sino también a los retos relacionados con las políticas del reconocimiento de la diversidad. El artículo presenta dos casos de justicia indígena en México que permiten reconocer los modos en que las demandas de género y de derechos humanos se enfrentan a ideologías incrustadas en las prácticas de este tipo de justicia. Si bien dichas prácticas tienden a naturalizar la exclusión de las mujeres, por otro lado se muestra cómo las mujeres en estos procesos contribuyen al cuestionamiento de los modos tradicionales de justicia a través de la redefinición de sus propios marcos culturales.
