This has resulted in new challenges when attending to the demands of the victims of these crimes. These new challenges necessitate a questioning of the limits and scope of human rights discourse in relation to forced displacement in Mexico. The conclusions of this study emphasize the necessity to “vernacularize” the typology of forced displacement in order to challenge the forms of exclusion established by the existing definitions. |

Este artículo reconstruye los elementos simbólicos y prácticos que subyacen bajo la disputa reciente por la tipificación del delito de “desaparición forzada” en México. El análisis parte de la comprensión de un contexto en el que violencia política y violencia criminal se traslapan y confunden, generando nuevos retos para atender la demanda de las víctimas de este crimen. Los hallazgos derivan en un cuestionamiento sobre los límites y alcances del discurso de los derechos humanos y la necesidad de “vernaculizar” la categoría de desaparición forzada para enmendar las formas de exclusión que plantean los criterios preestablecidos. Este artigo reconstrói os elementos simbólicos e práticos que se ocultam sob a disputa recente pela tipificação do delito de “desaparecimento forçado” no México. A análise parte da compreensão de um contexto no qual a violência política e a violência criminal se superpõem e se confundem, produzindo novos desafios para atender à demanda das vitimas deste crime. Os resultados geram um questionamento sobre os limites e alcances do discurso dos direitos humanos e da necessidade de “vernaculizar” a categoria de desaparecimento forçado para emendar as formas de exclusão que sugerem os critérios pré-estabelecidos.
