description This article analyzes the process of state formation in Mexico, focusing on the case of the state of Oaxaca, where the role of indigenous forms of governance are examined in the relation to the construction of state power. Drawing on ethnographic material it examines how the concept of government of the indians circulates in a variety of contexts in which different actors –legal experts, academics, leaders and indigenous intellectuals– construct this concept through everyday social practices which in turn undergirds the way in which the state constantly produces and reproduces itself. These diverse local practices demonstrate that the strength of the state in Mexico is in its fragmented and decentered nature even if its existence is predicated on formal institutions and the law.

Este artículo estudia la formación del estado en México, en particular en el estado de Oaxaca, lugar donde se analiza el papel de las formas de gobierno indígena en la construcción de un orden estatal. Con base en material etnográfico se muestra cómo el concepto de gobierno de los indios circula por una variedad de escenarios en donde actores diferentes –juristas, académicos, líderes e intelectuales indígenas– contribuyen a su definición en la vida cotidiana, de manera que el estado se produce y reproduce incesablemente. Estos diversos sitios dan cuenta de la existencia, en México,de un estado que encuentra su potencia en su propio carácter fragmentado y descentrado, al tiempo que formula su existencia en referencia al derecho y la ley. Este artigo estuda a formação do estado em México, particularmente em Oaxaca, lugar aonde se analisa o papel das formas de governo indígena na construção de uma ordem estatal. Com base em material etnográfico, mostra-se como o conceito de governo dos índios circula por uma variedade de cenários aonde atores diferentes –juristas, acadêmicos, líderes e intelectuais indígenas– contribuem à sua definição na vida cotidiana, de maneira que o estado se produz e reproduz incessantemente. Estes diversos lugares dão conta da existência, em México, de um estado que encontra sua potência em seu próprio caráter fragmentado e descentrado, ao tempo que formula sua existência e referência ao direito e à lei.
