description This article examines the impact that the covid-19 pandemic had on learning and the right to education in Latin America. This study assesses whether remote education policies that Governments in the region issued considered the international standards provided by the International System for the Protection of Human Rights (ISPHR). The aim of the assessment was to verify whether policies effectively provided continuity to learning and supported the right to education. An analytical and descriptive methodology that used international human rights treaties, reports issued by ISPHR allied organisations and public policies implemented by governments in educational matters, helped to identify the problems that made the application of this education policies in Latin American countries unsuccessful. It is concluded that, given its devastating effects, the advent of covid-19 further aggravated the shortcomings of national education systems, most of which failed to ensure inclusive and quality education in line with international standards.

Este artículo examina el impacto de la pandemia del covid-19 en el aprendizaje y el derecho a la educación en Latinoamérica. Para ello, se determina si las políticas de educación a distancia, emitidas por los Gobiernos de turno, se adecuaron a los estándares internacionales provistos por el Sistema Internacional de Protección de Derechos Humanos (SIPDH). Se analiza si, en efecto, dieron continuidad al aprendizaje, salvaguardando el núcleo esencial del derecho a la educación. Bajo una metodología analítica y descriptiva se recurre a los tratados internacionales en materia de derechos humanos, los informes emitidos por los órganos que conforman el SIPDH y algunas políticas públicas implementadas por los Gobiernos en materia educativa para identificar las principales fallas que han hecho infructuosa la aplicación de estas modalidades de enseñanza en los países de América Latina. Se concluye que, ante sus devastadores efectos, la llegada del covid-19 avivó aún más las falencias de los sistemas educativos nacionales, los cuales, en su gran mayoría, no garantizaron una educación inclusiva y de calidad apegada a los estándares internacionales.
