This research is of a documentary type and analyses why the public budget matters in enforcing rights (housing, health, and education). This study uses a conceptualization of human rights and proposes introducing social rights to guarantee fair living conditions within the role of Public Administration. It considers the public needs, how States addressed these needs historically, and the availability of financial resources (taxes, public budget, and planning) to attend social rights. This article focuses on the role of judicial power concerning the enforcement of social rights and assesses cases in South Africa and Venezuela regarding social rights. The study concludes that constitutions or declarations of social rights are not enough to assure effectiveness and that budget availability has a predominant place in enforcing rights. |

El cumplimiento de los derechos sociales tiene relación con la dinámica financiera de los Estados, los cuales someten su acción gubernamental a la planificación y disponibilidad de recursos. La presente investigación tiene por objetivo analizar la importancia del presupuesto público en el cumplimiento de derechos sociales como vivienda, salud y educación. Esta investigación, de tipo documental, utiliza el esquema de contenido a partir de la conceptualización de los derechos humanos e introduce los derechos sociales como medios para garantizar condiciones dignas de vida a partir del rol de la Administración pública. Para esto se valoran las necesidades públicas, su satisfacción en el tiempo y la disponibilidad de recursos que comprende tributos, presupuesto público y planificación. Se considera el rol del poder judicial ante la exigibilidad de los derechos sociales, al tomar en consideración casos representativos en Sudáfrica y Venezuela. Se concluye que los textos constitucionales que reconocen los derechos sociales no son suficientes para su efectividad y que las disponibilidades presupuestarias ocupan un lugar importante para su cumplimiento.
