Constituent processes, the establishment of a social State in a formal sense and the delegation of enabling laws caused the law to lose its place in a State governed by the rule of law. This study presents a brief but meticulous documentary compilation of literature that deals with this problem, special emphasis has had the contributions of Laporta, Hayek and Nieto. The latter has often denied the existence of the principle of legality. It is concluded that power will always seek to disregard legality and, therefore, individual freedoms are not duly protected. Finally, the article seeks to feed this discussion further and enhance its relevance to build solid democratic pillars.

Ciertos factores relacionados con la negación de la ley como protectora de la libertad y limitadora del poder político, estarían en el origen de esta crisis. Procesos constituyentes, instauraciones de un Estado social en sentido formal y delegaciones de leyes habilitantes han hecho que la ley ceda posiciones en un Estado de derecho. Este estudio realiza una breve pero minuciosa recopilación de literatura que ha abordado dicha problemática, con especial énfasis en los aportes de Laporta, Hayek y Nieto. Este último, a menudo ha negado la existencia del principio de legalidad. Se concluye que el poder siempre procurará desconocer la legalidad y, por lo tanto, las libertades individuales no tendrán la protección debida. Por último, el artículo procura que esta discusión se mantenga vigente y no pierda la relevancia para construir sólidos pilares democráticos.
