Public service theories, such as constitutional guarantees and mechanisms to satisfy general interest, were revised to find out whether the current Ecuadorian economic constitutional model enjoys legal flexibility to promote private management of public services. This article’s methodology applies an analytical and comparative approach to the economic model that shapes public services as stated both in the Ecuadorian Constitution of 1998 and that of 2008. This study concludes that the tensions between the economic models of public service provision can ease if the constitutional system adequately guarantees consumers’ freedom of choice rights and the freedom of the private sector to participate in the management of public services, including under privatization administrative techniques. |

Este artículo identifica las tensiones teóricas generadas a partir de la implementación de modelos constitucionales económicos, que pueden ser de carácter estatal (planificación centralizada) o favorables a la liberalización económica y las técnicas de privatización. Se revisan las teorías de servicios públicos como garantías constitucionales y medios de satisfacción del interés general, para conocer si el actual modelo constitucional económico ecuatoriano goza de flexibilidad jurídica para promover la gestión privada de servicios públicos. La metodología que utiliza este artículo es analítica y comparativa del modelo económico sobre servicios públicos previsto en la Constitución de 1998 frente al régimen establecido en la Constitución de 2008. La propuesta concluye que las tensiones entre los modelos económicos de prestación de servicios públicos pueden disiparse en el momento en que el sistema constitucional garantice de forma adecuada los derechos de libertad de elección de los consumidores y la libertad del sector privado para participar en la gestión los servicios públicos, inclusive dentro de las técnicas administrativas de privatización.
