description After the enactment of the Indigenous Communities Law, the province of Chaco in Argentina became one of the first in the country to establish relevant legislative modifications. These changes entailed the inclusion of the indigenous component in public policies, the application of criteria for defining the “indigenous question” and the creation of specific government entities for the administration of this population. This article aims to analyse the transformations introduced by this provincial regulation in the ways of defining and addressing the indigenous population, as well as the characteristics of the mechanisms implemented by the State. This paper suggests that beyond these legislative innovations, the State continued to address the indigenous issue as an eminently rural and agrarian problem, that it was necessary to constrain within that space, despite the internal migrations that took place from the countryside to the city.

Luego de la sanción de la Ley de las Comunidades Indígenas, la provincia del Chaco (Argentina) se convirtió en una de las primeras del país en establecer modificaciones relevantes en el orden legislativo. Estos cambios implicaron la incorporación del componente indígena en las políticas públicas, la aplicación de criterios de definición de la “cuestión indígena” y la creación de entidades gubernamentales específicas para la gestión de esta población. Este artículo tiene por propósito analizar las transformaciones que introdujo la normativa provincial en la forma de definir y abordar a la población indígena y qué características presentaron los mecanismos mediante los cuales el Estado intervino. Según esta propuesta, más allá de estas innovaciones legislativas, el Estado siguió abordando el tema indígena como una cuestión rural y agraria que era necesario contener y delimitar en ese espacio, pese a las migraciones internas que tenían lugar del campo a la ciudad.
