Durante la segunda mitad del siglo XIX la dirigencia adoptó el ethos iluminista del "debido proceso", aplicando una legislación y una política fiscalizadora pertinentes. Sin embargo, este ideal friccionaba con una necesidad contextual de control social. La hipótesis de investigación es que el avance del paradigma garantista fue moldeado por la premura de la dirigencia por controlar las desviaciones al proyecto modernizante.
