Este artigo discute, como foi configurada a lei de patentes, principalmente a referente ao setor farmacêutico a partir de 1995 com a implementação do acordo TRIPS. O artigo apresenta as flexibilidades que devem ser usadas em benefício da saúde pública, o que foi reforçado pela Declaração de Doha em 2001.
