O presente artigo pretende investigar a legitimidade da judicialização das relações afetivas decorrentes da violência física e psicológica perpetrada contra a mulher no âmbito doméstico e familiar. Para tanto, foi realizado levantamento de dados em uma Vara Especializada em violência doméstica e familiar contra a mulher, na cidade de Vila Velha/ES, que compreendeu 144 pedidos de medidas cautelares distribuídas à Vara nos meses de abril a junho de 2011. Os dados revelam que a supremacia do homem é uma constante social, profundamente estabelecida, que emerge de um estado de exclusão das mulheres, gerando uma naturalidade nas agressões perpetradas em âmbito doméstico.
