Esta investigación surge de la preocupación por integrar los derechos indígenas en México para permitir la coexistencia pacífica de las instituciones del derecho positivo mexicano y los sistemas jurídicos de los 62 pueblos indígenas que viven en el país. Se basa en el reconocimiento de México como sociedad multiétnica y multicultural y en la importancia de los derechos humanos establecidos en favor de sus pueblos originarios gracias a las reformas de los art. 1° y 2° de la Constitución de los años 2001 y 2011, respectivamente.
