De nuevo en la actualidad complejas realidades como las crisis recurrentes en los sistemas políticos contemporáneos, invitan a cuestionar la reificación del estado y su función de ficción concertada para la conservación del statu quo. En consecuencia, el objetivo de la investigación es debatir sobre las condiciones de posibilidad que se requieren para producir un derecho post-estatal, más allá de la coacción de un poder vinculante. En lo metodológico se hizo uso de una versión reelaborada de la mayéutica.
