El artículo busca reflexionar sobre la vigencia del derecho humano y fundamental al trabajo decente en América Latina, a partir de la aproximación entre categorías de pensamiento decolonial y estudios críticos del derecho, así como la revisión de la literatura sobre las especificidades del trabajo y el derecho laboral en este continente. La investigación es de carácter teórico y se realizó a partir de fuentes bibliográficas en los campos del derecho, la historia, la sociología y la economía, presentes en libros y artículos en revistas científicas especializadas. O artigo busca refletir sobre a eficácia do direito humano e fundamental ao trabalho digno na América Latina, a partir da aproximação entre categorias do pensamento descolonial e dos estudos críticos do direito, bem como da revisão da literatura sobre as especificidades do trabalho e do direito do trabalho neste continente. A pesquisa é de natureza teórica e foi realizada a partir de fontes bibliográficas dos campos do direito, da história, da sociologia e da economia, presente em livros e artigos de revistas científicas especializadas.
