| description | The paper, starting from judicial activism in Brazil in risk society, analyzes the Criminal Law as a formal mechanism to control sources of danger. Reflects performance of the criminal judge and its management in society whose sense of insecurity causes the collective fear. They analyze the criminal law in the risk society and the proactive role of the judiciary on the need for punitive message. The theoretical framework is based on judicial activism to replace public policies of the Legislative or Executive Power by the Judiciary (Baum, 1987) within the risk society, that is, developed in the middle of a chain of economic, political, scientific and which changed the scenario of the conditions of life in this society, thus creating a new criminal law based on a formal mechanism for controlling the various sources of danger of systemic origin (Buergo, 2001). Methodologically, it focuses on judicial activism and risk society. It appears that a new Criminal Law founded on the Constitutional State of Law is legitimate at the present moment, as long as it is committed to constitutional values and usurps the powers of other Powers. |

El artículo, basado en el reciente activismo judicial en Brasil en una sociedad de riesgo, analiza el derecho penal como un mecanismo formal para controlar las fuentes de peligro. Refleja el desempeño del juez penal y su gestión en la sociedad cuyo sentido de inseguridad causa miedo colectivo. El derecho penal en la sociedad del riesgo y el desempeño proactivo del poder judicial se analizan en vista de la constante necesidad de mensajes punitivos. El marco teórico se basa en el activismo judicial para reemplazar las políticas públicas del Poder Legislativo o Ejecutivo por el Poder Judicial (Baum, 1987) dentro de la sociedad de riesgo, es decir, desarrollada en medio de una cadena de factores económicos, políticos, científicos y que cambió el escenario de las condiciones de vida en esta sociedad, creando así una nueva ley penal basada en un mecanismo formal para controlar las diversas fuentes de peligro de origen sistémico (Buergo, 2001). Metodológicamente, se centra en el activismo judicial y la sociedad del riesgo. Parece que una nueva Ley Penal fundada en el Estado de Derecho Constitucional es legítima en este momento, siempre que esté comprometida con los valores constitucionales y usurpe los poderes de otras Potencias. O artigo, partindo do recente ativismo judicial no Brasil na sociedade de risco, analisa o Direito Penal como mecanismo formal de controle das fontes de perigo. Reflete a atuação do juiz penal e sua gerência na sociedade cuja sensação de insegurança provoca o medo coletivo. Analisam-se o direito penal na sociedade de risco e a atuação proativa do judiciário diante da necessidade constante de mensagem punitiva. O referencial teórico pauta-se em um ativismo judicial em substituição de políticas públicas do Poder legislativo ou Executivo pelo Judiciário (BAUM, 1987) dentro da sociedade de risco, ou seja, desenvolvida em meio de uma cadeia de eventos econômicos, políticos, científicos e culturais os quais modificaram o cenário das condições da vida desta sociedade, criando-se, assim, um novo direito penal pautado como mecanismo formal de controle das diversas fontes de perigo de origem sistêmica (Buergo, 2001). Metodologicamente foca-se em ativismo judicial e sociedade de risco.
