description | The objective of this study is to analyze the practices of justice towards young felons in Brazil, seeking to reflect, in the light of Brazilian legal culture, the ambiguities and consequences of a "punitive treatment" offered to them. It reflects on the ambiguity expressed in the ideal of recovery of the young people considered "deviants" in Brazil. As a background for understanding the meaning of practices and discourses, transformations and permanencies, one can call the particularities of a Brazilian "legal culture". Therefore, a historical review of previous and subsequent practices to the Statute of the Child and the Adolescent (ECA) is carried out, as well as an analysis of the experiences and meanings built by ex-offenders. The idea of ”‹”‹resocializing someone is a modern invention that, in Brazil, is based on an ambivalent logic between punitive and caring justice. The peculiarities of the Brazilian legal culture provide, in part, elucidations for the development of this process in an unequal and hierarchical society. The rhetoric of universal human rights takes on a very specific meaning in our society: the right of the more human and less human. The invisibility of ex young felons in the country is illustrative of this problem. |

El artículo tiene por objetivo analizar las prácticas de justicia frente a los jóvenes en Brasil, buscando reflejar, a la luz de la cultura jurídica brasileña, sobre las consecuencias de un "tratamiento punitivo" a ellos conferido y sobre la ambigüedad expresada en el ideal de recuperación. Como pantalla de fondo para la comprensión del significado de las prácticas y de los discursos, de las transformaciones y de las permanencias, se tiene lo que se puede llamar de particularidades de una "cultura jurídica" brasileña. Para ello, se realiza una revisión histórica de las prácticas anteriores y posteriores al Estatuto da Criança e do Adolescente (ECA), además de un análisis de las vivencias y significados construidos por los jóvenes egresados ”‹”‹del Sistema Socioeducativo. La idea de resocializar a alguien es una invención moderna que, en Brasil, es pautada en una lógica ambivalente entre una Justicia punitiva y asistencial. Las peculiaridades de la cultura jurídica brasileña suministran, en parte, aclaraciones para el desarrollo de ese proceso. La retórica de los derechos humanos universales toma un sentido propio en nuestra sociedad: el derecho de los más y menos humanos. La invisibilidad de los egresados ”‹”‹del Sistema Socioeducativo es ilustrativa de ese problema. O artigo tem por objetivo analisar as práticas de justiça frente aos jovens em conflito com a lei no Brasil, buscando refletir, à luz da cultura jurídica brasileira, sobre as ambiguidades e as consequências de um “tratamento punitivo” a eles conferido. Reflete-se sobre a ambiguidade expressa no ideal de recuperação dos jovens considerados “desviados” no Brasil. Como tela de fundo para a compreensão do significado das práticas e dos discursos, das transformações e das permanências, tem-se o que se pode chamar de particularidades de uma “cultura jurídica” Brasileira. Para tanto, realiza-se uma revisão histórica das práticas anteriores e posteriores ao Estatuto da Criança e do Adolescente (ECA), além de uma análise das vivências e significados construídos pelos jovens egressos do Sistema Socioeducativo. A ideia de ressocializar alguém é uma invenção moderna que, no Brasil, é pautada em uma lógica ambivalente entre uma Justiça punitiva e assistencial. As peculiaridades da cultura jurídica brasileira fornecem, em parte, elucidações para o desenrolar desse processo em uma sociedade desigual e hierarquizada. A retórica dos direitos humanos universais toma um sentido próprio na nossa sociedade: o direito dos mais e menos humanos.
