Sumario:This text pretend, under the light of the texts of the anthropologist Rita Segato, worked at the seminar called “Elementary structures of the violence”, analyce the devices that  sustain the lack of legislative treatment of the projects that pretend legalize the abortion in Argentina. The text pretend view the symbolic supports to the lack of legal registration about the abortion practice, the tensions in which they are deployed, the subjects in conflict, and the presented areas disputed, too. Analyse the fundamental role of the State and the law as a discursive vehicle of the same, in respect the hold-down place of women.  This analysis pretends visualize the transfer from colonialism to the modern state consolidation and the implicatios of the abortion practice privation. For the last, the text pretend delineate perspectives in favor of the inscription of the abortion practice to the legal narrative.
